Provisions on the Granting of Postponements and Installment Payments for Customs-and-Excise Debt Updated and Applicable on 28 February 2024

  • The Minister of Finance ("Minister") has issued Regulation No. 154 of 2023 on the Postponement of and Installment Payments for Debt Within the Customs-and-Excise Sector, which is set to come into force on 28 February 2024. The new Regulation states that the Director-General of Customs and Excise ("Director-General") may approve postponements and installment payments in relation to excise debt ("Postponements and Installments").
  • The types of debts for which Postponements and Installments may be granted relate to the following areas: 1) Stipulation letters; 2) Invoice letters; 3) Decrees of the Director-General on objections; or 4) Decisions of the tax court. However, it should be noted that Postponements and Installments will not be available for any debt that is currently the subject of administrative or legal efforts.
  • Debtors (pihak yang terutang) may submit applications for Postponements and Installments to the Director-General through the Head of a Customs-and-Excise Office before a notification of forced letter (surat paksa) is sent to said debtors. Such applications must fulfill the following general requirements: 1) Must be signed by the debtor; and 2) Must be submitted along with various required documents (e.g. financial statement, stipulation letter, invoice, financial information, etc.). After an examination has been completed, the Director-General will either approve or reject a given application within ten days of said application being duly received.
