BKPM Introduces Incentives for Imports and/or Submissions of CBU-Four-Wheeled-BEV and CKD-Four-Wheeled-BEV

  • Following the mandate set out under Regulation of the President No. 79 of 2023 on the Amendment to Regulation of the President No. 55 of 2019 (collectively referred to as "Regulation 79/2023"), the Minister of Investment/Investment Coordinating Board (Badan Koordinasi Penanaman Modal - "BKPM") has decided to set various guidelines and rules for the granting of incentives for imports and/or submissions of four-wheeled, battery-powered, electric motor vehicles ("Four-Wheeled-BEV") in order to accelerate investment through the issuance of Regulation No. 6 of 2023 ("Regulation 6/2023"), which will come into force on 13 January 2024.
  • The following types of four-wheeled-BEV can now be incentivized: 1) Completely built-up, four-wheeled-BEV ("CBU-Four-Wheeled-BEV") (i.e. import duty tariffs of 0% and luxury-goods sales tax [Pajak Penjualan atas Barang Mewah - "PPnBM"] that will be borne by the government); 2) Completely knocked-down, four-wheeled-BEV ("CKD-Four-Wheeled-BEV") (i.e. import duty tariffs of 0% on imports of CKD-Four-Wheeled-BEV and PPnBM that will be borne by the government for submissions of CKD-Four-Wheeled-BEV). The period of incentive utilization runs from the date of promulgation of Regulation 6/2023 until 31 December 2025.
  • Meanwhile, business actors who are looking to secure incentives should submit their applications for imports and/or submissions of four-wheeled-BEV through the Online Single Submission ("OSS") System, in the form of: 1) Proposal letter for incentive granting; 2) Approval letter for incentive utilization. It is important to note that, as outlined in point (2) above, applications must be submitted by no later than 1 March 2025.
  • In cases where business actors do not submit industrial verification certificates until 30 April 2028 and do not fulfil part or all of the relevant commitments, the Minister will issue a letter imposing sanctions on the relevant business actors demanding that they to complete the payment of sanctions amounting to the incentives that have been utilized in relation to any unrealized commitments.
