Government Ratifies Treaty on Prohibition of Nuclear Weapons

  • In order to implement the Preamble of the 1945 Constitution of the Republic of Indonesia, which aims to ensure that the country plays an active role in terms of efforts aimed at the creation of a global order that is based on notions of independence, lasting peace and social justice, the Indonesian Government has ratified Law No. 22 of 2023 on the Ratification of the Treaty on the Prohibition of Nuclear Weapons (Traktat Mengenai Pelarangan Senjata Nuklir – "TPNW"), which has been in force since 20 December 2023.
  • The TPNW aims to serve as a comprehensive international legal framework capable of regulating the global prohibition of nuclear weapons, guaranteeing the sovereign right of every state to utilize nuclear energy for peaceful purposes. The scope of the treaty encompasses prohibition, declarations, safeguards, efforts to eliminate nuclear weapons, national implementation, international cooperation, meetings, financing, amendment processes, dispute settlement, universality, signing, ratification, entry into force, reservations, withdrawal from the TPNW, relationships with other treaties, depositary parties and original text.
  • State parties to the TPNW must comply with various obligations, including prohibitions on the development, testing, production, possession, transfer and use of nuclear weapons within their respective jurisdictions. Said parties are also required to report any past possession of nuclear weapons, comply with International Atomic Energy Agency safeguards, verify the elimination of nuclear weapons programs, adopt legal measures, provide assistance to victims of nuclear weapons explosions, cooperate with other countries and attend meetings and conferences as observers.
  • The Indonesian Government supports the ratification of the TPNW in order to strengthen its position as a promoter of a global nuclear weapons ban, to provide adequate legal bases, to strengthen support for international ethics and norms related to nuclear weapons and to put political and moral pressure on states that possess nuclear weapons. This ratification also aims to strengthen the national commitment to nuclear disarmament, advance the non-proliferation agenda and encourage the utilization of nuclear energy for peaceful purposes.
