DPR Introduces 20 New ITE Law Amendments and Inserts

  • The Indonesian House of Representatives (Dewan Perwakilan Rakyat - "DPR"), working with the government, has reached an agreement to approve the Bill on the Second Amendment ("Second Amendment") to Law No.11/2008 on Electronic Information and Transactions ("ITE Law").
  • The approval of the Second Amendment encompasses 20 substantive changes, including a number of new provisions that specifically relate to electronic transactions, sanctions for violations that involve children, prohibitions on the dissemination of illegal content and government authority over access termination.
  • Furthermore, the Second Amendment also increases protections for children, specifically in terms of the use of electronic systems, and also strengthens prohibitions on illegal content and fake news, while expanding the government’s authority over access termination. A number of new provisions have also been introduced that specifically address the government’s responsibility to create a fair, accountable, safe and innovative digital ecosystem.
  • Indonesia’s Minister of Communication and Information Technology, Budi Arie Setiadi, has issued a statement that highlights the social dynamics that have been in play during the first eight years of the ITE Law’s enforcement and the widely perceived need to revise the law in line with technological developments and changing security demands. The revised ITE Law tackles this evolving IT landscape and aims to strengthen and guarantee the freedoms and rights of citizens within the context of security and public order.
