Ethical Guidelines for Artificial Intelligence Set to Be Introduced: Non-Compliance Will Not Result in Sanctions

  • The Vice-Minister of Communication and Information Technology, Nezar Patria ("Vice-Minister") has affirmed that due to a rapid increase in the global utilization of Artificial Intelligence ("AI") systems, the Ministry of Communication and Information Technology ("Ministry") is currently working on a Draft Circular on the Ethical Guidelines for Artificial Intelligence ("Draft Circular") which, as its title suggests, will now serve as a reference for the establishment of internal procedures for the utilization of AI.
  • In this regard, the Vice-Minister has also affirmed that due to the fact that the introduction of generative AI has gained a considerable amount of public attention of late, the Draft Circular itself will ultimately affect a wide range of business entities that currently utilize AI, ranging from startups to multinational companies. Given this widespread usage, the Vice-Minister has emphasized that ethical considerations relating to AI have a vital role to play in terms of proportionality, utilization and the development of AI itself.
  • According to the Vice-Minister, the goal of the Draft Circular is to ensure that AI technology ultimately has a positive impact on relevant parties whilst simultaneously mitigating any negative impacts or losses that may arise from the use of said technologies. Moreover, AI should be utilized in line with various principles (e.g. inclusivity, transparency, accountability and so forth), although the Vice-Minister has affirmed that no sanctions will be imposed in relation to any acts of non-compliance with the Draft Circular, as the new framework will serve solely as a set of normative guidelines, at the present time at least.
  • Meanwhile, Parasurama Pamungkas, a researcher from the Institute for Policy Research and Advocacy (ELSAM), is urging the government to ensure that the forthcoming Draft Circular will not only apply to electronic systems providers (Penyelenggara Sistem Elektronik – "PSE") operating within the private sector but also to public-sector PSE. In this regard, the hope is that the Draft Circular will ultimately complement Regulation of the Government No. 71 of 2019 on the Organization of Electronic Systems and Transactions.
