Implementation of Legally Binding Decisions by Business Actors Increased by 7.2% During 2018 - 2023 Period

  • The Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha - "KPPU") has announced that the implementation of legally binding decisions by business actors increased by 7.2% during the 2018 - 2023 period. More specifically, in 2018 the percentage of permanent legal change decisions that were not implemented stood at 58.7%, whereas this year’s figure stands at 51.5%, resulting in an overall increase of 7.2% in the percentage of decisions being implemented.
  • KPPU Chairman, Afif Hasbullah, affirmed during a media discussion that was held at the KPPU Office in Jakarta on Monday that the effective implementation of KPPU decisions is measured by comparing the number of legally binding decisions that are handed down with the number of these decisions that are not implemented. As a result, the enforcement of business competition processes by the KPPU is currently seen as making positive progress and involves close cooperation between the KPPU, law enforcers and various other institutions.
  • The KPPU has also been organizing various business competition compliance programs ("Compliance Programs") since 24 March 2022. These programs aim to improve the overall compliance of businesses with Indonesia’s business competition laws and to encourage business activities that are in line with the norms of fair competition. A total of 43 companies have already signed up to these compliance programs in line with the following sectoral breakdown: 1) Manufacturing sector (44%); 2) Services sector (23%); 3) Construction sector (9%).
  • It should be noted that of the 43 total registrants, the KPPU has issued seven determinations for registered compliance programs.
