OJK Regulates Electronic Submissions for Licensing, Approvals and Reporting by Financing and Sharia Financing Companies

  • The Financial Services Authority (Otoritas Jasa Keuangan – "OJK") recently issued Circular No. 20/SEOJK.06/2023 ("Circular 20/2023") on Electronic Submissions for Licensing, Approvals and Reporting (collectively referred to as "Submissions") by Financing and Sharia Financing Companies (collectively referred to as "Companies"), which has been in force since 9 November 2023.
  • During Submissions, Companies must upload self-assessment forms, as provided under the Appendix to Circular 20/2023, and said forms must have been signed by the relevant Company directors. Submissions should be completed electronically through data communications network systems that are facilitated by the OJK through the uploading of scanned copies of authentic documents. Submissions that are completed by email or in-person are only permitted in cases where systems are experiencing technical problems or force-majeure events, as announced through the OJK’s website.
  • It should also be noted that Companies must also retain printed copies of all submitted documents, which may subsequently be verified and/or validated by the OJK to ensure their authenticity and accuracy. Documents that take the form of reports specifically must be retained for a minimum period of five years after the relevant reporting date.
