Government Amends Procedure for Submission of Clemency Applications

The Minister of Law and Human Rights ("Minister") has issued Regulation No. 26 of 2023 ("Amendment"), which has now revised the currently applicable framework of Regulation of the Minister No. 49 of 2016 on the Procedure for the Submission of Clemency Applications ("Regulation 49/2016").
The Amendment features three new provisions that specifically address the following areas: 1) Children’s Special Coaching Institutions (Lembaga Pembinaan Khusus Anak - "LPKA"); 2) Foster Children (i.e children who have reached 14 years of age but who are still under 18 years of age and who are in LPKA foster care); 3) Clemency Applications and the Electronic Granting of Legal Clemency Considerations ("Clemency Applications").
