BUMN Exempted from Maximum Area Thresholds for Certain Plantation Commodities

In a bid to enhance the productivity and downstreaming of plantation businesses, the Government recently amended Regulation No. 26 2021 on the Organization of the Agricultural Sector ("Regulation 26/2021") through the issuance of Regulation No. 52 of 2023 ("Amendment"), which has been in force since 10 November 2023.
In essence, the Amendment clarifies that the maximum area thresholds for land utilization for certain plantation commodities, as originally set under Regulation 26/2021, now exempt state-owned enterprises ("BUMN") and/or BUMN subsidiaries, as assigned by the central government. Said assignments should be aimed toward the realization of various strategic objectives, including the provision of public services or benefits, support for the welfare of planters or the modernization of the plantation industry.
