Government Urged to Prioritize Draft Bill on Associations

  • The Central Management of the Indonesian Association of Notaries (Pengurus Pusat Ikatan Notaris Indonesia – "PP INI") recently organized a national seminar that specifically addressed various issues relating to the practice of associations (perkumpulan) in Indonesia, including the proposed Draft Bill on Associations ("Draft Bill"), which is still a significant distance from being passed into law.
  • Tri Firdaus Akbarsyah, the Chairman of PP INI, explained during the seminar that although there has been a significant increase in the number of established associations within Indonesia, the currently applicable provisions that address the preparation of associations’ deeds of establishment by notaries are still set out under the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) and Staatblad. Accordingly, Agung Iriantoro, the General Secretary of PP INI, has emphasized that the government should prioritize the formulation of a new Draft Bill in order to guarantee the provision of legal protection by notaries, as well as legal certainties for individuals who utilize notarial services for association-related documents.
  • Also expressing a view on this matter was Mr. Taufik, Head of PP INI’s Organizational Division, who recently stated that various aspects of the Draft Bill will need to be further discussed with a wide range of stakeholders, including an adequate definition of associations and what defines them as legal entities, as well as setting out the relevant governing and supervisory authorities. Ultimately, PP INI has stated its readiness to provide input in relation to both the Draft Bill and the Academic Draft of the Draft Bill.
