Government Introduces New Framework on Vehicle Customization: Customized Motorized Vehicles Now Required to Be Tested and Certified

  • The Minister of Transportation ("Minister") has introduced a dedicated framework on motorized vehicle ("Vehicle") customization ("Customization") through the issuance of Regulation No. 45 of 2023 (“Regulation 45/2023”), which has been in force since 25 September 2023. At its core, any Vehicles that have been registered and that are identifiable are permitted to be customized (e.g. adjustments may be made to their main technical specifications and/or requirements), provided that said Vehicles still complete mandatory periodic testing.
  • Pursuant to Regulation 45/2023, the above-mentioned Customizations may be applied to certain forms of Vehicles, including: 1) Motorcycles (which may be customized into special Vehicles for persons with disabilities); 2) Passenger cars; and 3) Freight cars (which must not exceed the permitted maximum weight of 5,500 kg and which may be customized into campervans).
  • Regulation 45/2023 affirms that Customizations may only be carried out by certain parties, including: 1) General workshops; 2) Agencies or institutions; or 3) Autobody industry companies. Moreover, said Customization parties must first secure approvals from the Director-General of Land Transportation prior to engaging in any Customization activities.
  • Ultimately, any Vehicles that have been customized by any of the above-described parties must undergo certain examinations that will address the following specific aspects: 1) The fulfillment of technical requirements; and 2) Roadworthiness. Vehicles that pass these examinations will be issued Customization testing certificates that will then serve as the basis for the registration and issuance of customized Vehicle certificates.
