Investment-Oriented Land Allocation Framework Introduced: Certain Forest Areas Now Prohibited from Being Utilized by Mining and Plantation Businesses

  • In a bid to further manage the utilization of investment-oriented land, the government has decided to introduce a new framework that addresses various matters that relate to the allocation of land for investment purposes ("Land Allocations") through the issuance of Regulation of the President No. 70 0f 2023 ("Regulation 70/2023"), which has been in force since 16 October.
  • Land Allocations should be implemented through processes of land re-management ("Re-Management"), as implemented by the Land Allocation Task Force ("Task Force"), which will soon be established by the president. Ultimately, the Task Force will make recommendations to the Minister of Investment regarding the adjustment and/or revocation of certain business permits that relate to land usage.
  • Re-Management processes should address the applicable Land Allocations and classifications that correspond to the relevant businesses. In terms of the latter aspect, said classifications include: 1) Economic or natural resource potential of land; 2) Zoning or spatial planning conformity of the relevant businesses; 3) Scope of optimal utilization; 4) Residential and indigenous community areas; and 5) Land sustainability and environmental protections.
  • It should also be noted that under Regulation 70/2023, lands that derive from areas of released forest with rates of cover of over 70% or forests with high environmental protection potential must be protected and prohibited from being utilized by mining and plantation businesses. However, any lands that do not meet the above thresholds should be categorized as abandoned land (tanah terlantar) and will subsequently be recommended for management by the Task Force through the land bank.
