Govt. Renews Procedures for Issuance and Registration of IUP under Certain Conditions

The Minister of Energy and Mineral Resources (“Minister”) recently issued Decree No. 297.K/MB.01/MEM.B/2023 on Processing Procedures for the Issuance and Registration of Mining Business Licenses (“Decree 297/2023”) in response to a number of problems that have emerged regarding the processing of mining business licenses in the wake of the introduction of previous Decree of the Minister No. 15.K/HK.02/MEM.B/2022 (“Previous Decree”),[1] including overlapping Mining Business Licenses Areas (Wilayah Izin Usaha Pertambangan – “WIUP”) for the same commodities and unregistered Mining Business Licenses (Izin Usaha Pertambangan –“IUP”) that are discovered during IUP reconciliation reporting, and so forth.[2] As a result, the promulgation of Decree 297/2023 on 15 September 2023 revoked the Previous Decree and declared it invalid.[3]
