National Strategy for Enforcement of Human Rights During Business Activities Introduced

On 26 September 2023, the government issued Regulation of the President No. 60 of 2023 on National Business and Human Rights Strategy ("Regulation") as the basis for the preparation of the National Business and Human Rights Strategy (Strategi Nasional Bisnis dan Hak Asasi Manusia/ "Stranas BHAM").
Stratnas BHAM will ultimately be condensed into a set of guidelines for use by ministries, institutions, local governments and business actors in order to enforce and protect aspects relating to human rights during business activities. (Art. 1 [2])
The Stranas BHAM must address the following areas: 1) Obligation of the government to protect human rights during business activities; 2) Responsibility of business actors to respect human rights; and 3) Rehabilitation facilities for victims of human rights violations during business activities that should be implemented through various BHAM activities, as comprehensively set out under the Appendix to the Regulation on the BHAM National Task Force (Gugus Tugas Nasional Bisnis dan Hak Asasi Manusia/ "GTN BHAM"). Furthermore, BHAM activities will be monitored and evaluated in coordination with the GTN BHAM.
