Employers Failing to Comply with Job Vacancy Reporting Mandate to Be Subject to Administrative Sanctions

  • The government has decided to update the mandatory job vacancy ("Vacancy") reporting requirement that originally featured under Decree of the President No. 4 of 1980 ("Decree 4/1980") through the issuance of Regulation of the President No. 57 of 2023 ("Regulation 57/2023"), which has been in force since 25 September 2023. The introduction of Regulation 57/2023 means that Decree 4/1980 has now been repealed and replaced.
  • In essence, Regulation 57/2023 addressed that both domestic and overseas Vacancies shall be reported to the Minister of Manpower ("Minister") through the Manpower Information System ("System"). As domestic Vacancies reporting are mandatory for employers across the nation, said domestic Vacancy reports should contain the following Vacancy-related information: 1) Identity of the employer; 2) Position title and the number of employees required; 3) Vacancy period; and 4) Information on the relevant positions (e.g. age, gender, educational and competence background, work experience, salary and so forth). Note that the information outlined in points (1) and (3) above was not required to be reported under the previous framework of Decree 4/1980.
  • The above-described information, as reported through the System, should also be made available to the general public. Moreover, in addition to being utilized by relevant job seekers and employers, said Vacancy-related information may also be utilized during the planning, placement and/or analysis of manpower-related matters. In this regard, any Vacancies that are filled should subsequently be reported by the relevant employer to the Minister via the System.
  • It should also be noted that the government may recognize employers by bestowing awards on them if they actively participate in the reporting of Vacancies. Conversely, any employers that fail to meet the abovementioned domestic Vacancy reporting mandate, including the non-reporting of any Vacancies that have already been filled, will be subject to the imposition of administrative sanctions.
