Governors, Mayors and Regents Across Jabodetabek Area Required to Implement Air Quality Control Measures

  • The Minister of Home Affairs, Tito Karnavian, ("Minister") has issued Directive No. 2 of 2023 ("Directive 2/2023"), which has been in force since 22 August 2023 and which sets various mandates for regional heads (i.e. governors, mayors and regents) across the Jakarta, Bogor, Depok, Tangerang and Bekasi ("Jabodetabek") area to address the ongoing deterioration in the air quality in said areas. This mandate includes implementation of the following measures: 1) Hybrid working systems; 2) Limits on the use of motorized vehicles; 3) Improvement of public transportation services; 4) Intensification of emissions controls; and 5) Management of industrial waste.
  • In terms of the measure outlined in point (1) above, Directive 2/2023 mandates that regional heads across the Jabodetabek area should implement a 50:50 ratio Work from Home (WFH) and Work from Office (WFO) policy for civil servants and employees of state/regionally owned enterprises. However, this policy will exempt employees who directly engage in public/essential services.
  • In terms of limits on the use of motorized vehicles, in addition to the intensification of emission testing, Directive 2/2023 also mandates that regional governments should further promote the utilization of non-emission vehicles such as electric vehicles, which should be provided through various incentives and other facilities for users. Moreover, said limits should also be achieved through the utilization of public transportation, which should encompass travel incentives and discounts.
  • Finally, in order to tackle one of the primary contributors to the deteriorating air quality in the Jabodetabek area, Directive 2/2023 also mandates that regional governments should encourage the use of scrubbers and renewable energy across industrial sector businesses. Meanwhile, any failure to pass emissions testing may result in the imposition of fines on violators. (ANT)
