Law on IKN Set to Be Revised to Ensure Punctual Relocation of Indonesias Capital City

  • The government is currently in the process of deliberating the Draft Bill on Nusantara Capital City ("Draft Bill") in order to replace Law No. 3 of 2022 on the Capital City ("Law 3/2022") and to address several newly identified challenges and issues which have, to date, become a bottleneck in terms of the punctual relocation of Indonesia’s capital city.
  • Several issues are set to be further accommodated under the Draft Bill, as follows: 1) The interpretation gap regarding the phrase "Special Authority", as designated to the Authority of Nusantara Capital City (Otorita Ibu Kota Nusantara – "OIKN"), specifically in relation to its duties and functions; 2) The position of the OIKN as a budget user and asset user, as well as independent funding carried out by the OIKN, as the government of a special region; 3) Specific provisions that address land rights for residents, as well as the re-organization of land in order to ensure clearer regional management by the OIKN; 4) Specific provisions for parties that invest in the development of residences, as well as timeframes for land rights in order to further increase the competitiveness of investment; and 5) Further legal certainty regarding the continuation and progress of the development of Nusantara Capital, as well as the involvement and monitoring role of the House of Representatives.
  • It is hoped that the Draft Bill will ultimately catalyze the punctual relocation of the capital city so that it will ultimately meet the planned deadline for its completion. Furthermore, it is expected that the position of the OIKN will be strengthened and that the scope of its authority will be clarified, as well as ensuring greater legal certainty concerning the status of lands within the Nusantara Capital Region.
