Scope of Exported Natural Resources Goods Subject to Mandatory DHE Deposits Now Expanded

  • Following the issuance of Regulation of the Government  No. 36 of 2023 on Export Earnings (Devisa Hasil Ekspor – “DHE”) from Businesses, Management and/or Processing Activities Relating to Natural Resources ("Regulation 36/2023"), the Minister of Finance ("Minister") has decided to introduce an updated list of exported natural resources goods ("Exported Natural Goods") that are subject to mandatory DHE deposits into the Indonesian financial system ("DHE Deposits") through the issuance of Decree No. 272 of 2023 ("Decree 272/2023"), which has been in force since 1 August 2023.
  • It should be noted that the enforcement of Decree 272/2023 has now simultaneously repealed and replaced the previous framework to set out a list of Exported Natural Goods subject to mandatory DHE Deposits, i.e. Decree of the Minister No. 744/KM.4/2020, which bore the same title as Decree 272/2023 ("Decree 744/2020").
  • While maintaining the same Exported Natural Goods sectors subject to mandatory DHE Deposits that originally featured under Decree 744/2020, the issuance of Decree 272/2023 has now revised the list of Exported Natural Goods themselves, as comprehensively featured under the Appendix to Decree 272/2023.
  • The listed Exported Natural Goods sectors that feature under Decree 272/2023 include: 1) Mining sector: 209 goods (previously 180 goods); 2) Plantation (perkebunan) sector: 567 goods (previously 472 goods); 3) Forestry: 263 goods (previously 190 goods); and 4) Fisheries sector: 506 goods (previously 366 goods)
