- The Supreme Court (Mahkamah Agung – "MA") has issued Circular No. 1 of 2023 ("Circular 1/2023"), which establishes a procedure for the delivery of summonses and notifications to parties (including third parties) who do not possess electronic domiciles during administration processes and electronic court trials by way of registered letters.
- Summonses and/or notifications that are sent by registered letters should be delivered to the relevant parties through letters that are addressed to the recipients, which must be proven through receipts from the recipients stating the relevant receipt dates.
- Summonses and/or notifications must be delivered directly (by hand) to the relevant parties, otherwise, they should be delivered to adults who live in the same houses or apartments as the relevant parties.
- Submissions of summonses and/or notifications by registered letter must be accompanied by evidence/information of receipt that can be accessed electronically and that features the following content: 1) Date of receipt; 2) Identity of recipient; 3) Photo of the recipient and the identity card of the recipient, if received by an adult who lives in the same house/apartment as the parties or a receptionist/security officer in an apartment/flat/other similar residence; 4) Receipt that has been signed and stamped, if received by the lurah/village head (including kelurahan/village officials). However, if said lurah/village head/offcials are not willing to provide a signature and stamp, then the statement should have the following added to it: "lurah/village head/officials are not willing to provide a signature and stamp"; and 5) Receipt coordinates (geotagging).
- Circular 1/2023 has been in force since 5 July 2023.
