Indonesian Advocates Expected to Understand and Implement PDP Law to Prevent Data Leaks

  • Following the promulgation of Law No. 27 of 2022 on Personal Data Protection ("PDP Law"), the Secretary-General of the Central Leadership Council of the Indonesian Advocates Association has emphasized the importance of promoting understanding and implementation of the PDP Law among advocates, given that the protection of individuals’ personal data represents a crucial element of legal practice in the current digital era.
  • Despite technological advances that allow individuals to enjoy ease and benefits relating to areas such as e-commerce, e-government and e-banking, it is an unfortunate fact of the modern world that data leaks often result from the use of such digital tools. One example of this is the ever-growing presence of spam or promotional short message service (SMS) messages, despite the recipients not having shared their personal phone numbers with the relevant senders. Moreover, the risk of data leaks is not only an area of concern to businesses but also to banks, which are expected to have more advanced cyber-security policies and measures in place.
  • Given that data leaks continue to occur across Indonesia with worrying frequency, the hope is that the PDP Law will be properly implemented by advocates so that personal data protection guarantees can be provided, as well as ensuring that corporations are able to offer secure and reliable infrastructure capable of adequately protecting personal data.
