National Water Sustainability Index Introduced

  • In order to achieve the various water resource (Sumber Daya Air – "SDA") management goals set out under Law No. 6 of 2023 on the Stipulation of Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation, the government has now set various National SDA Policies (Kebijakan Nasional SDA – "Jaknas SDA") through the issuance of Regulation of the President No. 37 of 2023 ("Regulation 37/2023"), which has been in force since 16 June 2023. The promulgation of Regulation 37/2023 simultaneously repealed and replaced the previous Jaknas SDA framework that was specifically addressed under Regulation of the President No. 33 of 2011.
  • The newly determined Jaknas SDA will be applicable until 2030 and may be reviewed on a five-yearly basis. While details of Jaknas SDA are comprehensively outlined under the Appendix to Regulation 37/2023, the new policies broadly break down as follows: 1) General policies; 2) Improvement of sustainable SDA conservation; 3) Improvement of SDA utilization; 4) Improvement of SDA damage and risk controls; 5) Improvement of public and business empowerment in relation to SDA management; and 6) Improvement of SDA information systems.
  • The Jaknas SDA will be implemented as a part of efforts aimed at increasing national water sustainability through the minimum achievement of the determined Sustainable Development Goal (SDGs) targets and the national mid-term development plan, which encompass eight targets in total (e.g. access to drinking water, access to sanitation, improvement of water quality and so forth).
  • In order to achieve an adequate level of national water sustainability, Regulation 37/2023 has now introduced the National Water Sustainability Index (“Index”), which comprises the national-, provincial- and river-area level indexes. The Index should be calculated by the relevant government agencies on a two-yearly basis and should be used as guidance for the drafting of future SDA-related programs and policies.
