Multilateral Convention to Implement Measures Related to Double Taxation Avoidance Agreements Enters into Force

In line with the ratification of the Multilateral Convention to Implement Tax Treaty-Related Measures to Prevent Base Erosion and Profit Shifting ("Convention"), the Director General of Taxes has now issued Circular No. SE-5/PJ/2023, which in essence provides notifications relating to the following matters: 1) The application of the Indonesia - Seychelles Tax Treaty; 2) The process of signing and implementing the Convention by the Government of the Republic of Indonesia and the Government of the Republic of Seychelles; 3) The dates upon which the Convention and also the Convention for Agreement on the Avoidance of Double Taxation (Persetujuan Penghindaran Pajak Berganda – "P3B") Indonesia - Seychelles come into force; and 4) Main provisions in the Convention that apply to the Indonesia - Seychelles Tax Treaty.
Based on Article 34 of the Convention, the Convention came into force for Indonesia on 1 August 2020 and for the Seychelles on 1 April 2022.
