Certain Regions Prohibited from Exporting Sea Sand

  • The Cabinet Secretary, Agung Pramono, has stated that regions that meet certain criteria will not be allowed to engage in exports of sea sand. Said criteria will be further elaborated upon in the implementing regulation to Regulation of the Government No. 26 of 2023 on the Management of Marine Sedimentation Products ("Regulation 26/2023").
  • Under Article 9 of Regulation 26/2023, the utilization of sea sand sedimentation should generally be focused on domestic reclamation projects, the development of government infrastructure and the establishment of facilities by businesses. Sea sand sedimentation may also be used for export purposes but only if the relevant domestic requirements have already been fulfilled. However, in terms of the exporting of sea sand sedimentation products themselves, the Minister of Marine Affairs and Fisheries is currently working on a new set of ministerial regulations in conjunction with the Minister of Energy and Mineral Resources that will determine the various regions that are either allowed or not allowed to export the sea sand sedimentation products.
  • In addition, Regulation 26/2023 also specifies that exported sea sand sedimentation products will be subject to the imposition of higher non-tax revenue fees in comparison to products that are utilized for domestic purposes.
