Climate Action and Carbon Cooperation Governance Regulated

In an effort to control climate change, the Minister of Environment and Forestry has issued Circular No. SE.5/MENLHK/SETJEN/PPI.3/5/2023 on Climate Action and the Governance of Carbon Cooperation, which came into force on 10 May 2023.
In order to reduce greenhouse gas emissions (Gas Rumah Kaca – "GRK") and thus control climate change, the government is required to implement various measures, as specifically addressed under Regulation of the President No. 98 of 2021 on the Implementation of Carbon Economic Value to Achieve Nationally Determined Contribution ("NDC") Targets and Control Over GRK in Relation to National Development. This framework encompasses various instruments, including the following: 1) Business/activities actors ("Actors") must register mitigation action taken in order to reduce GRK emissions through a National Registration System; 2) During calculations of GRK emissions reductions, Actors must apply measurable, reportable, verifiable (MRV) principles; 3) Overseas carbon trading must involve official authorization.
In terms of the governance of regional government cooperation with foreign parties (government or private), the following measures should be stressed: 1) Should be undertaken in accordance with the relevant laws and regulations; 2) Aspects relating to legality must be considered; 3) Any non-compliance to with legality-related aspects may result to indications of violations.
