Minister of Energy and Mineral Resources Adjusts Prerequisites for Certain Natural Gas Users and Prices Within the Industrial Sector

  • The Minister of Energy and Mineral Resources ("Minister") has issued Decree No. 91.K/MG.01/MEM.M/2023 on Natural Gas Users and Prices Within the Industrial Sector ("Decree 91/2023"), which has been in force since 19 May 2023 and which replaces Decree of the Minister  No. 134.K/HK.02/MEM.M/2021 ("Decree 134/2021"), which bore the same title. 
  • As detailed comprehensively under the Appendix to Decree 91/2023, the applicable prices of natural gas that were originally set under Decree 134/2021 for the 2023 - 2024 period have now been adjusted. However, generally speaking, the applicable provisions that address prices and users remain similar to those that featured under Decree 134/2021 and were previously summarized in the following edition of Daily Updates: “Provisions on Certain Users and Prices of Natural Gas Within the Industrial Sector Updated”.
  • Newly featured under Decree 91/2023 are allocated natural gas volumes ("Volumes") for users of natural gas, which have now been determined based on the availability of natural gas supplies and/or the adequacy of state revenues. In terms of Volumes themselves, Decree 91/2023 now explicitly states that unabsorbed Volumes may be commercially sold (through the application of determined natural-gas prices) to other users that have been prioritized within the industrial sector.
  • Furthermore, Decree 91/2023 has now added several additional obligations that apply to natural-gas users, including: 1) Commercial sales of excess Volumes at determined prices if state revenue has been deemed inadequate; 2) Submission of required data for evaluation purposes; and 3) Implementation of energy conservation management (for users that are specifically mandated under relevant laws and regulations).
