Draft Amendment to Industrial Design Law Set to Be Completed by End of 2023

  • Plenty of gaps remain to be closed as regards the implementation of Law No. 31 of 2000 on Industrial Design ("Law 31/2000"), including the protection and development of micro-, small- and medium-scaled enterprises (usaha mikro, kecil dan menengah – "UMKM"). Accordingly, the Regional Representative Council (Dewan Perwakilan Daerah – "DPD") is currently targeting the completion of the Draft Amendment to Law 31/2000 ("Draft Amendment") by the end of 2023.
  • The Draft Amendment is being aimed at accommodating the interests of domestic industry, particularly UMKM, so that they will be able to enjoy full industrial design rights and thus increase their competitive value at both the national and international levels. Furthermore, the Draft Amendment is expected to be able to accommodate the development of domestic industry, provide higher quality services through the simplification of legal frameworks and also facilitate the community so that citizens are able to enjoy full legal protections.
  • Some of the key points addressed by the Draft Amendment include the realization of fairness for the domestic design community, particularly within the UMKM sector, and to provide chances for said community to develop its creativity. The Draft Amendment will also be able to accommodate rapid industrial growth, as catalyzed by technological advancements and the dynamics of international law. Furthermore, the Draft Amendment will introduce a declarative system for industrial design with a short commercial cycle period, such as three-year protections within the fields of fashion, crafts and textile design. In addition, criminal sanctions will also be available in relation to industrial design violations that involve the replication and trading of certain designs.
