Management of State Property and Assets under Control of Nusantara Capital City

Minister of Finance has issued Regulation No. 53 of 2023 on the Management of State Property and Assets under Control of Nusantara Capital City ("Regulation 53/2023"), which came into force on 11 May 2023.
Regulation 53/2023 sets out details of the management of State Property (Barang Milik Negara – "BMN") and Controlled Assets (Aset Dalam Penguasaan – "ADP") that are located in Nusantara Capital City. Management aspects themselves include, among others: 1) Planning of BMN budgetary requirements; 2) Procurements; 3) Utilization of BMN and ADP; 4) Security and maintenance; 5) Assessments; 6) Destruction; and so forth.
The utilization of the BMN includes the following forms: 1) Rent; 2) Lease; 3) Utilization cooperation; 4) Build for handover; 5) Infrastructure Provision Cooperation (Kerja Sama Penyediaan Infrastruktur – "KSPI"); and 6) Limited cooperation for infrastructure financing.
It should be noted that KSPI is implemented by the Nusantara Capital Authority working alongside partners that may comprise private business entities in the form of limited liability companies. foreign legal entities, state-owned enterprises, regionally owned enterprises, and BUMN subsidiaries that function in the same as way BUMN or cooperatives.
