Govt. Set to Adjust PNBP Conformity Approval Tariff for Marine Area Utilization Activities

  • The Director-General of Marine Areas Management at the Ministry of Marine Affairs and Fisheries ("Ministry"), Victor Gustaf Manoppo ("Director-General"), has confirmed that the Ministry is currently preparing to adjust the applicable Non-Tax State Revenue (Pendapatan Negara Bukan Pajak – "PNBP") tariff for Conformity Approvals for Marine Area Utilization Activities (Persetujuan Kesesuaian Kegiatan Pemanfaatan Ruang Laut/PKKPRL) ("Tariff") that originally featured under Regulation of the Government No. 85 of 2021. This regulatory framework addresses every applicable PNBP that falls under the Ministry’s purview ("Regulation 85/2021").
  • The Director-General has expressed the hope that the forthcoming Tariff adjustment will be able to further improve the ease of doing business for business actors from all walks of life. Overall, the new Tariff is being aimed at several goals, including: 1) Establishment of a fairer Tariff; 2) Reduction in the burdens currently placed on business actors; 3) Reduction in risk levels; 4) Support for investment in marine area utilization; and 5) Provision of further legal certainty regarding ownership of business locations for fisherman and fisheries cultivators.
  • In terms of the above-described adjustment, the Acting Director of Marine Area Planning at the Ministry, Suharyanto ("Director"), has affirmed that the proposed new Tariff will encompass a diverse set of characteristics that relate to fisheries activities and locations, and will include two Tariff bases: 1) Method of activities (e.g. reclamation and non-reclamation); and 2) Types of activities (e.g. business and non-businesses).
  • The Director has also stated that the current Tariff of Rp. 18,680,000/hectare, as set under Regulation 85/2021, needs to be further reviewed as it is widely seen as unfair in its application to low-to-medium-risk business activities, as undertaken across various maritime regions across the nation.
