Overview
It is incontrovertible that digital innovations are having a significant impact on the healthcare sector. One type of digital innovation that is currently affecting the healthcare sector is the emergence of telemedicine. Throughout 2022, Indonesia recorded a total of 17.9 million health consultation activities which were carried out via 19 different telemedicine companies.[1] In providing incentives in response to the rapid growth in digital healthcare innovation (“DHI”), the government may issue various conventional legal frameworks in order to accommodate said innovations across Indonesia. However, given the rapid growth in innovations of this type, the issuance of legal frameworks is seen as a less efficient approach that is not adequately capable of accommodating these quickly emerging technologies and the novel nature of such innovations. In this regard, given the overall processes and timeframes required to formulate and issue a comprehensive legal framework for this area, it is widely believed that by the time of their promulgation, said regulations would not be able to adequately accommodate the most recent features of DHI.[2]
