PNBP Payments for Intellectual Property Applications Revised

General Corporate Tax and Non-Tax Charges

The Directorate-General of Intellectual Property has introduced a number of changes in relation to the flow of Non-Tax State Revenue (Pendapatan Negara Bukan Pajak – "PNBP") payments. PNBP is imposed upon applicants that wish to protect their intellectual property ("IP"), as addressed under Regulation of the Government No. 45 of 2016 on Types and Tariffs of PNBP Applicable at the Ministry of Law and Human Rights.
In essence, through the new flow, it is hoped that the general public will more easily be able to protect their IP due to the fact that they will no longer be required to access other websites in order to proceed with their applications. This new flow came into force on 3 May 2023, specifically in relation to new applications for: 1) Patents; 2) Industrial designs; and 3) Patent maintenance. Meanwhile, new applications for trademarks are set to commence on 12 May 2023.
