Government Responds to Upcoming Judicial Review Petition of the Revised Job Creation Law

  • The Secretary of the Directorate-General of Industrial Relations Development and Social Security for Manpower at the Ministry of Manpower, Surya Lukita, has claimed that the issuance of Law No. 6 of 2023 on the Stipulation of Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation as Law (“Law 6/2023”) provides further protections for laborers and employees across the nation in comparison with previous legal frameworks as a result of the following aspects: 1) Expansion of access to employment (given Indonesia’s unemployment figures have recently spiked as a direct result of the Corona Virus Disease 2019 [COVID-19] pandemic); 2) Protection for workers under Temporary Employment Agreements (Perjanjian Kerja Waktu Tertentu/PKWT), outsourcing or contract-based employment; and 3) Guaranteed compensation for terminated workers.
  • Mr. Lukita has also claimed that Law 6/2023 has stimulated investment growth across Indonesia and should, as a result, provide more job opportunities, while further improving the manpower skillsets needed by domestic workers so that they will be able to compete with foreign workers, as well as boosting the establishment of work training institutions.
  • From the perspective of labor, Ahmad Supriadi, the Head of the Tangerang Regency Chapter of the Confederation of Indonesian Workers Unions, claims that the implementation of Law 6/2023 has resulted in several problems, including: 1) Regulation of the Minister of Manpower No. 5 of 2023 on the Adjustment of Wages and Working Hours for IPKBE Affected by Global Economic Changes has resulted in low wages; 2) Certain companies are still engaging in mass redundancies, especially in relation to union activists within the Tangerang area; and 3) Several issues relating to the implementation of Law No. 36 of 2009 on Health have resulted in the inability of the general public to access the required medical healthcare.
