- The Witness and Victims Protection Agency (Lembaga Perlindungan Saksi dan Korban – “LPSK”) has issued Regulation No. 1 of 2023 (“Regulation 1/2023”) on the Fulfillment of the Rights of Victims of Corruption Crimes (“Victims”), which in essence grants Victims the following rights: 1) Medical support; 2) Psychosocial and psychological rehabilitation; 3) Compensation for families in cases where Victims pass away; and 4) Other types of compensation.
- In order to secure the above-mentioned rights, applicants (i.e. Victims and their families, heirs or attorneys) should submit duty-stamped, written requests to the LPSK. The requirements that have to be met by written requests vary depending on the type of rights that are being addressed. For example, Victims who are seeking compensation should submit detailed elaborations that address the types of losses that they have suffered.
- The LPSK will then carry out administrative evaluations for a maximum of seven business days followed by evaluations of substantive requests for a maximum of 30 business days. Administrative evaluations should be carried out by ensuring that a complete set of required documents have been submitted with the relevant requests, while substantive evaluations should be carried out in order to assess various factors (i.e. status of the Victim’s submission, condition of the Victim and their needs, etc.)
- In addition to providing an overall set of provisions that address the rights of the Victims, Regulation 1/2023 also sets out the procedure through which overseas Indonesian Victims can ensure the fulfillment of their rights.
