KPI Regulates Procedure for the Imposition of Sanctions in Response to Broadcasting Content Infringements

The Indonesian Broadcasting Commission (Komisi Penyiaran Indonesia – "KPI") has issued Regulation No. 1 of 2023 on the Procedure for the Imposition of Administrative Sanctions in Response Broadcasting Content Infringements ("Regulation 1/2023"), which has been in force since 16 March 2023.
Broadly speaking, the scope of Regulation 1/2023 covers the following matters: 1) Sources and follow-ups to alleged violations of broadcasting content rules; 2) KPI administrative sanctions; and 3) Support and facilitation of the KPI Secretariat.
The new regulation states that allegations of violations are generally sourced from findings, reports and/or recommendations that are provided by Regional KPI. Follow-up measures will be initiated in response to said allegations and may include the following activities, amongst others: 1) Collection of evidence; 2) Verification; 3) Investigation; 4) Clarification; 5) Plenary session for the imposition of KPI administrative sanctions, etc.
Any broadcast programming which is legitimately proven to have violated the Broadcasting Code of Conduct and the Broadcasting Program Standards will be subject to the imposition of administrative sanctions, which may take the following forms: 1) Written reprimands; 2) Administrative fines; 3) Temporary suspension of broadcasting activities; 4) Limitations being placed upon broadcasting durations and times; and/or 5) Termination of broadcasting activities at certain hours.
