Provisions on the Training and Examination of Intellectual Property Consultants Introduced

  • In order to implement various provisions originally set out under Regulation of the Government No. 100 of 2021 on Intellectual Property Consultants, the Minister of Law and Human Rights has issued Regulation No. 15 of 2023 ("Regulation 15/2023"), which has been in force since 17 March 2023.  
  • According to Regulation 15/2023, the training of intellectual property consultants ("Training") is to be organized by the Directorate-General of Intellectual Property ("Directorate-General"), which may cooperate with other institutions that fulfill the following criteria: 1) Professional intellectual property consultant ("Consultant") organizations; or 2) Accredited universities that are capable of providing high-quality teaching and learning facilities for the implementation of Training.
  • Managements of professional organizations and universities should apply electronically in order to engage in this type of cooperation and organize Training to the Director-General of Intellectual Property ("Director-General") attaching the following documents: 1) Proposals or terms of reference for activities accompanied by budget and cost plans; 2) Accreditation certificates (for universities); 3) Statutes/bylaws (for professional organizations); and 4) Statement on the ability to provide high-quality teaching and learning facilities.
  • Examinations of Consultants ("Examinations") are to be implemented by the Directorate-General and the relevant candidates should apply to the Director-General by filling out a registration form. Parties entitled to become Examination candidates comprise: 1) Consultant candidates who have completed the Training; and/or 2) Retired employees of the Directorate-General who meet the requirements to become Consultants.
  • In order to be able to take Examinations, candidates must attach the following required documents: 1) Examination registration form; 2) Training certificate; 3) Retirement decree (for candidates who are retired Director-Generals); and 4) Proof of Examination payment.
