Minister of PUPR Sets Guidelines for Road Function Worthiness

  • In order to realize the orderly administration of the country’s roads and the availability of roads that comply with security and safety requirements and that also ensure the smooth flow of passengers and goods, the Minister of Public Works and Public Housing ("Minister") has issued Regulation No. 4 of 2023 on Guidelines for Road Function Worthiness ("Regulation 4/2023"), which has been in force since 24 February 2023.
  • Operational roads must be functionally worthy, which should be determined based on the results of roadworthiness testing that are in line with relevant technical and administrative requirements and that are then drawn up as certificates of roadworthiness.
  • Fulfillment of the technical requirements for road function worthiness will result in roads being classified as falling into one of the following five categories: 1) 1 star; 2) 2 stars; 3) 3 stars; 4) 4 stars; or 5) 5 stars. Roads can be declared worthy if various administrative and technical requirements are met and must also be categorized as follows at the minimum: 1) Toll roads: 4 stars; 2) New non-toll roads: 3 stars; 3) New non-toll roads without pavement/cover: 2 stars; and 4) Non-toll roads that are already in operation: 1 star. Road function worthiness should be evaluated periodically at least every 10 years and/or as required. 
  • Technical requirements refer to: 1) Technical structures of road surfaces; 2) Technical structures of complementary buildings and connecting roads; 3) Technical geometric roads; 4) Technical utilization of road sections; 5) Technical implementation of traffic management and engineering; 6) Technical requirements for road equipment. Meanwhile, administrative requirements encompass traffic-regulation instructions, orders and prohibitions, as well as requirements that relate to road equipment, road status, road class, land ownership, road space, road ledgers and the environment.
