- The Amendment to Law No. 32 of 2002 on Broadcasting ("Law 32/2002") has been in the pipeline for a number of years now and the current state of play is that Commission I at the House of Representatives (Dewan Perwakilan Rakyat – "DPR") is still in the process of drafting the amendment. This process is expected to be completed by the end of the 2019 to 2024 period.
- It is widely believed that advances in technology mean that there is now a greater need than ever to revise Law 32/2002. In this regard, rapid technological developments are disrupting the entire broadcasting industry, which is currently being transformed from its traditional model to a new technological paradigm that involves digitally-based broadcasting. This ongoing process of technological disruption is ultimately prolonging the formulation of the Amendment to Law 32/2002, which remains in process to this day.
- However, while this technological disruption is undoubtedly proving to be an obstacle in terms of the formulation of the new law, said technological disruption is also the underlying reason behind the urgent need to complete the amendment. In this regard, the ongoing failure to provide a solid legal basis for broadcasting across Indonesia is leading to a dysfunctional situation in terms of the various regional legal instruments that address these matters. It is therefore imperative that the government affirms its strong commitment to completing the Amendment to Law 32/2002.
- The DPR has revealed that the Draft Bill on the amendment is currently being processed by Commission I and will soon be harmonized by the Legislative Body. The hope is that the amendment will be completed before the end of the current DPR session.
