Legal Scholars and Professors Urge Passing of Draft Bill on Drug and Food Control

  • A number of legal scholars and experts from across the country recently visited the President’s Advisory Board (Dewan Pertimbangan Presiden/Wantimpres) in order to urge the government to pass the Draft Bill on Drug and Food Control ("Draft Bill"), as well as to push for the mandatory labeling of Bisphenol A ("BPA") on all packaged drinking water products ("Products").
  • Among these scholars, Professor and Dean at the Faculty of Pharmacy at the University of Airlangga, Professor Juanidi Khotib, has stated that the passing of the Draft Bill is an urgent matter and that the bill should be incorporated into the priority legislation list so that it can be passed into law as soon as possible. According to Professor Khotib, this issue is urgent due to the fact that the current food and drug controls in Indonesia are not yet comprehensive, as indicated by the emergence of multiple drug poisoning cases, including recent high-profile cases involving ethylene glycol/diethylene glycol (EG/DEG) contamination, as well as the presence of liquid nitrogen in fast-food products popular with children.
  • Addressing similar concerns, the Head of the National Commission for Child Protection (Komisi Nasional Perlindungan Anak), Arist Merdeka Sirait, has stated that BPA substances have been discovered in Products that are being consumed by children. This finding has led Mr. Sirait to urge the government to make the BPA labeling of Products mandatory. Moreover, Mr. Sirait has also stated that post-market findings relating to Products that are packaged in polycarbonate drinking water containers may also lead to health issues among infants, toddlers and unborn children.
  • Meanwhile, Law and Public Policy Expert and special staff member at the University of Indonesia, Ima Mayasari, has also urged the president to immediately approve content relating to the Head of the National Agency of Drug and Food Control (Badang Pengawas Obat dan Makanan/BPOM) Regulation set out under the Draft Bill. In this regard, Mrs. Mayasari has also confirmed that Commission IX at the House of Representatives (Dewan Perwakilan Rakyat/DPR) has approved the Draft Bill for inclusion in the 2019 - 2024 National Legislation Program.
