- The Minister of Energy and Mineral Resources ("Minister") has issued Decree No. 33.K/MB.01/MEM.B/2023, which has been in force since 22 February 2023.
- The granting of licenses for the mineral and coal subsector (collectively referred to as "Licenses") is to be implemented through the Online Single Submission ("OSS") system, which can be accessed through the following official website: oss.go.id.
- The granting of approvals in relation to the above Licences breaks down as follows: 1) Approval of the relevant Annual Workplan and Funding Budget (Rencana Kerja dan Anggaran Biaya – "RKAB"); 2) Approval of any shareholder amendments; and 3) Other approvals. Said licensing processes should be implemented through the following means: 1) e-RKAB applications, which should be submitted through: erkab.esdm.go.id (for RKAB approvals); 2) Energy and mineral resources sector business and operational license applications, which should be submitted through: perizinan.esdm.go.id/minerba; 3) Emails, which can be sent to the following e-mail address: [email protected]; and 4) Other online applications that are available through the Directorate-General of Mineral and Coal ("Directorate-General").
- Licenses should be processed through the above-described licensing platforms, while parties are prohibited from making any direct visits to the Directorate-General’s office. However, if urgent circumstances require such visits to be made, then they should be completed in line with the following requirements: 1) Businesses/corporations/cooperatives must only be represented by their upper management (at the level of director or equivalent); 2) Said parties must first apply for a direct appointment through the available Directorate-General platforms; and 3) Upon arriving at the Directorate-General’s office as scheduled, said parties must show proof of their credentials.
