Apindo: Current Draft Bill on Health Likely to Reduce the Quality of Healthcare Facilities and Burden Employers and Employees

  • The Draft Bill on Health ("Draft Bill") has now officially been proposed by the House of Representatives (Dewan Perwakilan Rakyat – "DPR"). The new Draft Bill contains 478 articles and 20 chapters, was drawn up through the use of the omnibus method and is now set to enter its first stage of deliberation between the DPR and the government.
  • Haryadi Sukamdani, Chairperson of the Indonesian Employers’ Association (Asosiasi Pengusaha Indonesia – "Apindo"), has affirmed Apindo’s support for improving the quality of Indonesia’s public healthcare services, including the involvement of employees and workers through the National Social Security System (Sistem Jaminan Sosial Nasional/SJSN), as specifically addressed under the Draft Bill.
  • However, Apindo has also highlighted concerns that the quality of the healthcare services that are available to workers may ultimately suffer if the Drafty Bill ultimately passes into law. Moreover, Apindo is also claiming that the obligation of the Social Security Agency for Health (Badan Penyelenggara Jaminan Sosial Kesehatan – "BPJS Kesehatan") to accept any cooperation initiatives that are proposed by healthcare facilities, provided that said facilities have secured the required permits in accordance with the relevant applicable laws, runs contrary to the voluntary principle, as stipulated in Article 23 of Law No. 24 of 2011.
  • According to Sukamdani, the business world is also concerned that the costs associated with BPJS Kesehatan administration could potentially increase, which may in turn lead to an increase in the contributions that participants are required to make, resulting in an increased burden on both workers and employers.
