Regulation of the Government on the Investigation of Criminal Acts Within the Financial Services Sector: OJK and Indonesian National Police to Synergize Efforts

  • In order to support law enforcement synergy between the Indonesian National Police and the Financial Services Authority (Otoritas Jasa Keuangan – "OJK") in relation to the financial services sector, the Indonesian Government has issued Regulation of the Government No. 5 of 2023 on the Investigation of Criminal Acts Within the Financial Services Sector ("Regulation 5/2023").
  • According to Regulation 5/2023, criminal investigators operating within the financial services sector comprise investigators working for the Indonesian National Police Force and OJK investigators. OJK investigators comprise the following parties: 1) Investigating officers of the Indonesian National Police Force; 2) Certain types of civil servant officials; and 3) Certain employees who are granted special authority as investigators.
  • OJK investigators are authorized and have responsibility in relation to the following activities: 1) Receiving reports, notifications and complaints from individuals regarding criminal acts that are alleged to have taken place within the financial services sector; 2) Researching the veracity of reports or information on criminal acts that are alleged to have taken place within the financial services sector; 3) Researching all persons suspected of committing or being involved in criminal acts within the financial services sector, and so forth.
  • In carrying out their authorities and responsibilities, OJK investigators fall under the coordination and supervision of the Indonesian National Police Force. The coordination in question should be carried out through operational investigations of criminal acts that are alleged to have taken place within the financial services sector by prioritizing the principles of restorative justice and ultimum remedium.
  • Regulation 5/2023 has been in force since 30 January 2023.
