Minister of Energy and Mineral Resources Regulates Provision of Electrical Charging Infrastructure for Battery-Powered Electric Motorized Vehicles

  • The Minister of Energy and Mineral Resources ("Minister") has issued Regulation No. 1 of 2023 on the Provision of Electrical Charging Infrastructure for Battery-Powered Electric Motorized Vehicles ("Regulation 1/2023"), which has been in force since 13 January 2023.
  • In essence, electrical charging infrastructure for battery-powered electric motorized vehicles includes: 1) Recharging facilities, that should at the least comprise the following: a) Electrical power supply apparatus; b) Current, voltage and communication control systems; and c) Protection and security systems; and/or 2) Battery exchange facilities. The aforementioned battery recharging can be undertaken at private electrical installations and/or Public Electric Vehicle Charging Stations (Stasiun Pengisian Kendaraan Kendaraan Listrik Umum – "SPKLU"). Meanwhile, battery exchange facilities comprise Public Electric Vehicle Battery Exchange Stations (Stasiun Penukaran Baterai Kendaraan Listrik Umum – "SPBKLU") at which batteries for battery-powered electric motorized vehicles can be exchanged.
  • When implementing recharging business activities for battery-powered electric motorized vehicles, SPKLU business entities are required to operate online applications that should offer the following functionality at least: 1) Registration media for owners of battery-powered electric motorized vehicles; 2) Provision of information on the locations of battery-powered electric motor vehicle recharging stations and the types of sockets available; 3) Provision of information on charging rates for electrical power that is used during the charging of battery-powered electric motorized vehicles; 4) Provision of information on the amounts of electrical power available through connections used to charge battery-powered electric motorized vehicles; and 5) Media and transaction reporting for users of battery-powered electric motorized vehicles.
  • The electrical power tariffs that apply when charging battery-powered electric motorized vehicles should refer to electrical power tariff provisions provided by PT PLN (Persero) and which include: 1) Electrical tariffs for bulk sales purposes, for electrical charging at medium voltages for business license holders that offer integrated supplies of electricity in the public interest (Izin Usaha Penyediaan Tenaga Listrik untuk Kepentingan Umum – "IUPTLU"); 2) Electricity tariffs for special service purposes, for electrical charging at low voltages for integrated IUPTLU holders; 3) Electrical power tariffs should be set in accordance with the tariff groups of the relevant electric power installation owners, for electrical power charging from integrated IUPTLU holders to SPKLU business entities with charging technologies for four-or-more-wheeled vehicles in collaboration with other business entities; 4) Electrical power tariffs should be set in accordance with the tariff groups, for electrical power charging from integrated IUPTLU holders; 5) Electrical power tariffs for special service purposes, for electrical power charging from SPKLU business entities to owners of battery-powered electric motorized vehicles.
