Concerns Expressed over Draft Bill on Health

  • The House of Representatives (Dewan Perwakilan Rakyat – "DPR") is expected to give more weight to the opinions of the various stakeholders who have rejected the proposed formulation of a new Draft Bill on Health through the use of the omnibus law method. The omnibus idea has been largely rejected by professional health associations, including the Indonesian Doctors Association (Ikatan Dokter Indonesia – "IDI"). Moreover, in addition to rejecting the drafting of the new legal framework through the use of the omnibus law method, the IDI also opposes various other matters.
  • The Deputy Chairperson of the IDI, Slamet Budiarto, has stated that the idea of drafting the Draft Bill on Health through the application of the omnibus law method will result in the revocation of various sectoral regulations that relate to the healthcare sector, ranging from medical professionals to nursing. Slamet has stated that the revocation of these various sectoral regulations will result in the absence of applicable professional-based regulations for various healthcare professionals.
  • Furthermore, IDI has also identified a number of clauses under the Draft Bill on Health that may result in conflict between professional healthcare organizations, as well as the separation of professional organizations from their collegiums. Moreover, the presence of professional organizations, such as IDI, is critical to maintaining public participation. In addition, the collegiums provided under the new Draft Bill on Health may ultimately result in questions emerging regarding the purposes and authorities of collegiums.
  • IDI has also rejected a number of matters that relate to permits to practice within the healthcare sector and has noted that the Draft Bill on Health states that the attainment of competence to practice will be determined by the Ministry of Health and local governments. In this regard, IDI is asserting that all matters pertaining to expertise and practice should fall under its authority instead of that of the government.
