Combatting Illegal Fishing: DPD Proposes Amendment to Law on Fisheries

  • The Regional Representatives Council (Dewan Perwakilan Daerah – "DPD") has proposed a Draft Bill to amend Law No. 31 of 2004 on Fisheries ("Law 31/2004"). The view of the DPD is that a Draft Bill that will amend Law 31/2022 is essential in order to boost the prosperity and economic conditions of the country’s small fishermen.
  • An academic script is currently being drafted while the DPD is still soliciting input from academics regarding various implementation aspects in order to ensure that the Draft Bill covers all of the necessary areas. To date, the DPD has recorded at least 12 main issues that will be addressed, which include fisheries processing, management and businesses.
  • Bambang Santoso, a member of DPD Commission II, has noted that the Draft Bill will potentially lead to a regulatory gap that may last between 10 and 20 years. However, Santoso hopes that the amendment will be capable of detecting issues over the course of the next 20 years and will therefore be able to answer concerns relating to illegal fishing amid the slow pace of domestic technological developments.
