Govt. Renews Provisions on Customs Examinations Within the Import Sector

  • The Minister of Finance (“Minister”) recently issued Regulation No. 185/PMK.04/2022  on Customs Examinations Within the Import Sector (“Regulation 185/2022”), which comes into force on 12 January 2023 and which will simultaneously repeal and replace Regulation of the Minister No. 139/PMK.04/2007 (“Regulation 139/2007”), which bore the same title.
  • In essence, Regulation 185/2022 has been issued in an effort to improve the flow of goods through customs areas, as well as to introduce more advanced customs examinations within the import sector. This legal framework represents a part of the follow-up program for institutional bureaucratic reform.
  • The Director for Communication and Guidance for the Use of Services, Nirmala Dwi Heryanto, has stated that Regulation 185/2022 sets out various goods preparation procedures that should be implemented in line with the mechanism for goods preparation notices which are sent by importers to customs-and-excise officials or based upon notices for the preparation of goods, as issued by customs-and-excise officials to the relevant business actors.
  • Furthermore, Regulation 185/2022 also states that physical examinations of imported goods may be postponed under certain conditions, including the following: 1) Packaging and labeling are broken and/or have been opened; 2) Goods are categorized as special goods which make immediate physical examinations impossible; 3) Physical examinations require certain technical knowledge from technical experts, etc. (KEMENKEU)
