MK Granted 15 Judicial Review Petitions Throughout 2022

  • A spokesperson for the Constitutional Court (Mahkamah Konstitusi – “MK”), Fajar Laksono (“Spokesperson”), has affirmed that the MK processed a total of 147 cases during the course of 2022. These cases included four regional election disputes, while the rest comprised judicial review petitions (“Petitions”). Among the latter category, 124 Petitions have been ruled on and resulted in the following verdicts: 1) 15 granted Petitions (either partially or entirely); 2) 48 rejected Petitions; and 3) 42 unacceptable Petitions.
  • Among the abovementioned 15 granted Petitions, one Petition was granted in its entirety while the remainder were partially granted. Said granted Petitions include: 1) Decision No. 32/PUU-XIX/2021 on the Judicial Review of Law 7/2017 on General Elections (the final and binding characteristics of the General Elections Organizing Board [Dewan Kehormatan Penyelenggara Pemilu/DKPP] decision was contested and said decision may now be contested through the state administrative court); 2) Decision No. 37/PUU-XIX/2021 on the Judicial Review of Law No. 3 of 2020 on the Amendment to Law No. 4 of 2009 on Mineral and Coal Mining, as amended by Law No. 11 of 2022 on Job Creation; 3) Decision No. 71/PUU-XIX/2021 on the Judicial Review of the  Criminal Law Code (KUHP) and Law No. 42 of 1999 on Fiduciary Security (relating to parties authorized to execute fiduciary securities); 4) Decision No. 2/PUU-XX/2022 on the Judicial Review of Law No. 10 of 2016; and 5) Decision No. 28/PUU-XX/2022 on the Judicial Review of Law No. 8 of 1981 on Criminal Procedural Law (relating to indictment letters).
