- The recent scandal involving the distribution of substandard cough syrup has raised the question of the need to provide greater authority to the National Agency of Drug and Food Control (Badan Pengawas Obat dan Makanan – "BPOM"), as currently, BPOM is unable to take any actions aside from the revocation of licenses.
- In terms of the extension of the authority of BPOM, Herman Khaeron, the Head of the Legislative Body, believes that three fundamental issues have led to BPOM’s current weakness in its ability to adequately implement its supervisory duty: 1) The absence of BPOM executorial rights in relation to actors who violate the applicable laws and regulations; 2) The lack of any investigative follow-up mechanism in relation to situations where there are already preliminary findings; and 3) The BPOM’s authority is currently limited by other applicable Laws.
- The BPOM engages in strong and direct engagement with the general public and plays an important role in protecting the public, hence forthcoming plans for a Draft Bill on Drug and Food Controls will consider any violations in this area an extraordinary crime.
