OJK in Discussions with Financial Services Businesses and Stakeholders Regarding Law on Personal Data Protection

  • President Joko Widodo officially signed off on Law No. 27 of 2022 on Personal Data Protection ("PDP Law") on 17 October 2022. This law requires related parties to adjust their operations to the provisions set out therein within two years of its promulgation. As a follow-up, the Financial Services Authority (Otoritas Jasa Keuangan – "OJK") is currently coordinating and holding meetings with various parties, including business associations operating within the financial services industry, in order to discuss the new PDP Law.
  • The PDP Law regulates the various rights of personal data subjects, including usage and deletion. However, Article 15, Paragraph (1), Part (d) of the PDP Law excludes the rights of personal data subjects, as referred to in Article 8; Article 9; Article 10, Paragraph (1); Article 11; and Article 13, Paragraphs (1) and (2) of the PDP Law in the interests of the supervision of the financial services, monetary and payment system sectors and to ensure financial system stability, as implemented within the context of state administration.
  • Indonesia’s Minister of Communication and Information Technology, Johnny G. Plate, has stated that the government is now preparing an official Regulation of the President and a number of other implementing regulations to the PDP Law.  Mr. Plate went on to affirm that the government will carry out public consultations during the drafting of implementing regulations to the PDP Law. As a result, any other parties that are intending to issue sectoral regulations that address the implementation of the PDP Law should ensure that they do not overlap with the legal frameworks that are currently being drafted by the government.
