New Procedures Introduced for Rehabilitation of Aquaculture Environments

In order to further elaborate upon details relating to the rehabilitation of aquaculture environments, the Minister of Marine Affairs and Fisheries ("Minister") has issued Regulation No. 25 of 2022 on Procedures for Aquaculture Environmental Rehabilitation ("Regulation 25/2022").
According to Regulation 25/2022, aquaculture environmental rehabilitation ("Rehabilitation") may be carried out within and/or outside of aquaculture areas by government officials responsible for aquaculture ("Aquaculture Office") or by individuals or corporations, whether they take the form of legal entities or not ("Persons"), after said parties have first secured approvals from the relevant Aquaculture Office.
The scope of Rehabilitation, as defined under Regulation 25/2022, encompasses the following: 1) Identification of causes of pollution of fish resources and/or their environments and/or damage to fish resources and/or their environments ("Identification"); 2) Selection of Rehabilitation methods ("Method Selection"); and 3) Implementation of Rehabilitation ("Implementation").
Regulation 25/2022 mandates the submission of written reports on Rehabilitation by Persons to the relevant Aquaculture Office within a maximum of 30 business days of the completion of the relevant Rehabilitation. Reports should contain the following information at the least: 1) Identification; 2) Selected method; 3) Implementation; 4) Success rate of the Implementation; and 5) Any problems encountered and attempted solutions.
Regulation 25/2022 has been in force since 6 October 2022.
