Minister of Communication and Information Technology to Update Provisions on Utilization of the Radiofrequency Spectrum Through Class-Based Licenses

  • In an effort to optimize the utilization of the radiofrequency spectrum (“Frequencies”) and to allocate additional Frequencies based upon class licenses, the Minister of Communication and Information Technology (“Minister”) is currently preparing a Draft Regulation on the Utilization of the Radiofrequency Spectrum Based on Class Licenses (“Draft Regulation”), which will repeal and replace Regulation of the Minister  No. 1 of 2019, which addressed similar matters to the Draft Regulation, as well as Regulation of the Minister No. 16 of 2016 on Technical Requirements for Near Field Communication Devices when it ultimately comes into force.
  • The Draft Regulation sets out a list of telecommunications devices and/or tools that will be available for utilization based on the issuance of class licenses, which encompass the following: 1) Radio Local Area Network (RLAN); 2) Low Power Wide Area Network (LPWAN); 3) Short Range Device (SRD); 4) Class-Based International Mobile Telecommunications (IMT); and 5) Private Mobile Radio (PMR).
  • The Draft Regulation affirms that Frequencies must be utilized in compliance with the following provisions: 1) Must be used in harmony in sharing mode at certain times and in certain areas and/or must utilize technologies that are based on user coordination; 2) Must not cause any harmful interference; 3) Must not receive any interference protection from other Frequency license holders; and 4) Must be utilized in compliance with the determined technical provisions set out under Appendix II to the Draft Regulation.
  • The Draft Regulation is currently undergoing a process of internal deliberation and may thus be subject to further changes. In order to provide opportunities for the general public to submit responses to and improve the Draft Regulation, public consultations will be carried out until 27 October 2022 and inputs may be submitted via the following email addresses: 1) [email protected]; 2) [email protected]; 3) [email protected]; 4) [email protected]; and 5) [email protected].
