Govt. Plans Amendment to PNBP for BHP IPSFR

Tax and Non-Tax Charges Technology, Media and Telecomunication

The government is currently preparing a Draft Government Regulation ("Draft Amendment") as an amendment to Government Regulation No. 7 of 2009 on the Types and Tariffs of Non-Tax State Revenue (Penerimaan Negara Bukan Pajak – "PNBP") Applicable at the Department of Communication and Information. Overall, the Draft Amendment proposes several changes to provisions that specifically address Rights Fees for the Utilization of the Radiofrequency Spectrum for Radiofrequency Spectrum Licenses (Biaya Hak Penggunaan Spektrum Frekuensi Radio untuk Izin Pita Spektrum Frekuensi Radio – "BHP IPSFR").
The Draft Amendment Specifically states that BHP IPSFR should be determined based on the following mechanisms: 1) Selection, offering and appointment based on fairness and the purchasing ability of the general public; or 2) Calculations that are made through the use of the formulas set out under the Draft Amendment.
The Draft Amendment states that determinations that are completed through a selection mechanism will apply to BHP IPSFR in terms of the up-front fee and to IPSFR in terms of the annual fee. Meanwhile, the calculation mechanism will apply to the annual IPSFR fee.
